LICENSE AGREEMENT & TERMS OF SERVICE

1. Permitted/Prohibited Uses​
The images may be used for the sole purpose of marketing the specific property photographed for the duration of the listing. Images may not be given or sold to a third party. The images may be used for any press articles, marketing, on-line use, as well as any form of reproduction, printed or digital, needed to market the property that has been photographed for the duration of the listing. The photos may also be used by the agent’s parent company for the sole purpose of marketing the specific property photographed for the duration of the listing, and must NOT be distributed to a third party without permission. The images may be backed up or archived as necessary to complete the above stated uses only. You may not sell, resell, sub-license, give, lend, sub-let, distribute the whole or part of an image, whatever its size and resolution. PHOTOGRAPHER recognizes that CLIENT does not control how images are shared by MLS and syndicated to other property listing sites (Zillow, Realtor.com, et al.) and CLIENT is not liable for such use beyond license expiration. PHOTOGRAPHER reserves the right to re-license real estate images for commercial use by developers, builders, designers, vendors, or other parties.

2. Grant of License​
Upon receipt of payment, the Client ("Licensee") will be granted a license to use the photos and images provided. This license grants the Client (“Licensee”) an individual, non-transferable and non-exclusive right to use the photos in the manner as outlined under the permitted uses in Section 1 above. You may not share, sell, rent, lease, or sublicense the photos to any other companies or entities not mentioned in this license agreement.

3. Payments
Payment is expected before images can be downloaded and used. The pricing structure for services offered by Rulien Photography will be clearly communicated to the client. Additional fees, such as travel expenses or special requests, may apply and will be discussed and agreed upon in advance.

4. Cancellations & Weather
Cancellations must be made at least 24-hours before scheduled photoshoot start time. Real estate photoshoots cancelled with less than 24-hours notice may be subject to a cancellation fee of $50.
Weather-related cancellations are subject to the terms above. Some weather conditions can adversely affect exterior home photo quality or prevent safe drone flight. In the event of unfavorable weather, the interior photos will be photographed as planned. Alternate arrangements will be made for exterior or aerial re-shoot unless full cancellation or full rescheduled shoot is made at least 24-hours in advance. When weather is dry but blue skies are not present PHOTOGRAPHER will provide blue sky replacements on primary exterior images.
